The foundations of aesthetics, the arts, and art education have been re-examined in recent years in light of the resurgence of scientific aesthetics as a research discipline; the development of contemporary cognitive science encompassing aspects of computer science, psychology, philosphy, linguistics, and so on; and the advances of neuroscience.

After decades of single issue movements and identity politics on the U.S. left, the series of large demonstrations beginning in 1999 in Seattle have led many to wonder if activist politics can now come together around a common theme of global justice. This book pursues the prospects for progressive political movements in the 21st century with case studies of ten representative movements, including the anti-globalization forces, environmental interest groups, and new takes on the peace movement.

This book reviews the spectrum of economic methods that have been developed from themid-1970s to the mid-1980s to analyze the feasibility of solar systems and shows how the use ofthese techniques has influenced federally sponsored research, development, and demonstrationprograms.

We provide a retrospective of 25 years of the International Conference on AI and Law, which was first held in 1987. Fifty papers have been selected from the thirteen conferences and each of them is described in a short subsection individually written by one of the 24 authors. Hart Memorial Lecture: "Life’s Dominion: An Argument About Abortion and Euthanasia." Dworkin is Professor of Philosophy and Frank Henry Sommer Professor of Law at New York University. He received B.A. degrees from both Harvard College and Oxford University, and an LL.B. from Harvard Law School and clerked for Judge Learned Hand. He has been Professor of Jurisprudence at Oxford and Fellow of University College since 1969. In Brennan and Democracy, a leading thinker in U.S. constitutional law offers some powerful reflections on the idea of "constitutional democracy," a concept in which many have seen the makings of paradox. Here Frank Michelman explores the apparently conflicting commitments of a democratic governmental system where key aspects of such important social issues as affirmative action, campaign finance reform, and abortion rights are settled not by a legislative vote but by the decisions of unelected judges. Can we--or should we--embrace (...) the values of democracy together with constitutionalism, judicial supervision, and the rule of law? To answer this question, Michelman calls into service the judicial career of Supreme Court Justice William Brennan, the country's model "activist" judge for the past forty years. Michelman draws on Brennan's record and writings to suggest how the Justice himself might have understood the judiciary's role in the simultaneous promotion of both democratic and constitutional government.The first chapter prompts us to reflect on how tough and delicate an act it is for the members of a society to attempt living together as a people devoted to self-government. The second chapter seeks to renew our appreciation for democratic liberal political ideals, and includes an extensive treatment of Brennan's judicial opinions, which places them in relation to opposing communitarian and libertarian positions. The American administrative state is a feature of the new liberalism that is largely irreconcilable with the old, founding-era liberalism. At its core, the administrative state, with its delegation of legislative power to the bureaucracy, combination of functions within bureaucratic agencies, and weakening of presidential control over administration undercuts the separation-of-powers principle that is the base of the founders' Constitution. The animating idea behind the features of the administrative state is the separation of politics and administration, which was championed by (...) James Landis, the New-Deal architect of the administrative state for President Franklin Roosevelt. The idea of separating politics and administration, and the faith such a separation requires in the objectivity of administrators, did not originate with Landis or the New Deal but, instead, with the Progressives who had come a generation earlier. Both Woodrow Wilson and Frank Goodnow were pioneers in advocating the separation of politics and administration, and made it the centerpiece of their broad arguments for constitutional reform. J. Richard Gott III (1993) has used the “Copernican principle” to derive a probability density function for the total longevity of any phenomenon, based solely on the phenomenon’s past longevity. John Leslie (1996) and others have used an apparently similar probabilistic argument, the “Doomsday Argument,” to claim that conventional predictions of longevity must be adjusted, based on Bayes’ Theorem, in favor of shorter longevities. Here I show that Gott’s arguments are flawed and contradictory, but that one of his conclusions—his delta (...) t formula—is mathematically equivalent to Laplace’s famous (and notorious) ‘rule of succession’; moreover, Gott’s delta t formula is a plausible worst-case (if one favors greater longevity) bound in some contexts. On the other hand, the Doomsday Argument is fallacious: the argument’s Bayesian formalism is stated in terms of total duration, but all attempted real-life applications of the argument—with one exception, an application by Gott 1994—actually plug in prior probabilities for future duration; moreover, the Self-Sampling Assumption, an essential premise of the Doomsday Argument, is contradicted by the prior information in all known real-life cases. But rejecting the Doomsday Argument does not entail rejecting the possibility of learning about the future from the past. Applying the work of Bruce M. Hill (1968, 1988, 1993) and Frank P.A. Coolen (1998, 2006) in the field of non-parametric predictive inference, I propose and defend an alternative methodology for quantifying how past longevity of any phenomenon does provide evidence for future longevity. In so doing, I identify an objective standard by which to choose among counting time intervals, counting population, or counting any other measure of past longevity in predicting future longevity. This methodology forms the basis of a calculus of induction. (shrink)

In this paper I offered a friendly amendment to Paul Churchland’s a well-known criticism of Frank Jackson’s knowledge argument. According to Jackson’s argument, a hypothetical Mary, living in her darkened stimulus-impoverished environment, knows all information from physical science about the perception of color but still does not know everything, e.g., what it is like to experience the color red. Churchland offered a refutation by analogy whereby Mary is an ectoplasmologist who knows all the supposed nonphysical things that friends of (...) the hard problem of qualia believe about that phenomenon. So Mary knows everything ectoplasmic about the perception of color but still does not know everything – what it is like to experience the color red. I made a necessary adjustment whereby Mary is not just an ectoplasmologist but a dualist who knows everything physical and ectoplasmic about the perception of color. By the same reasoning, then, the Jackson-style argument would refute dualism too. I also offered a diagnosis of the problem much in the spirit of other criticisms, namely, that things like experiencing red or riding a bicycle can be fully physical even though Mary would not “know how” to experience red or ride a bicycle simply by possessing all the “know that”/propositional/book-learning about those things. The article addresses the issue of rationing health care services, a topic currently being hotly debated in many countries. The author argues that the aspect of causal responsibility ought to play a decisive role in the allocation of limited medical resources. Starting out from Ronald Dworkin's distinction between option luck and brute luck, the appropriate and meaningful uses of the term causal responsibility are clarified first. A discussion of the conditions which might justify giving lower priority to patients whose (...) illnesses are the result of unhealthy behavior, like e.g. alcohol abuse, follows. Causal responsibility is then viewed in the context of private health insurance and the club model of organ donation. It is argued that individuals themselves are basically responsible for their decisions regarding insurance coverage and membership in organ donors' clubs. Causal responsibility is shown to be a more suitable criterion for rationing scarce medical resources than other criteria which might alternatively be considered, such as patients' age. (shrink)

Although declarations of the death of God seem to be provocations announcing the end of the era of theology, this announcement is actually central to the Christian revelation in its most classic forms, as well as to its reworkings in contemporary religious thought. Indeed provocative new possibilities for thinking theologically open up precisely in the wake of the death of God. Already Hegel envisaged a revolutionary new realization of divinity emerging in and with the secular world through its establishment of (...) a total order of immanence. However, in postmodern times this comprehensive order aspired to by modern secularism implodes or cracks open towards the wholly Other. A hitherto repressed demand for the absolute difference of the religious, or for “transcendence”, returns with a vengeance. This difference is what could not be stated in terms of the Hegelian System, for reasons that poststructuralist writers particularly have insisted on: all representations of God are indeed dead. Yet this does not mean that they cannot still be powerful, but only that they cannot assign God any stable identity. Nietzsche’s sense of foreboding concerning the death of God is coupled with his intimations of the demise of representation and “grammar” as epistemologically bankrupt, but also with his vision of a positive potential for creating value in the wake of this collapse of all linguistically articulated culture. He points the way towards the emergence of a post-secular religious thinking of what exceeds thought and representation. (shrink)

Jedes Tableau der Handlungsmöglichkeiten, so abstrakt es auch abgefaßt sein mag, ist gebunden an Vorstellungen möglicher Handlungssubjekte, denen wir Handlungsmöglichkeiten zuschreiben. Handlungstheorie ist daher notwendig Reflexion unserer Praxis, in der wir uns selbst als Selbstbewußtsein erfahren, das seinem Verhältnisbewubtsein enthoben (...) ist, ohne dieses dadurch selbst schon aufzuheben zu können. Daß uns Freiheit im Handeln unaufhebbar prekär und problematisch bleiben mub, ist die Grundvoraussetzung dafür, dab wir Handlungstheorien historisch und bereichsbezogen ständig neu entwerfen müssen. Das Verhältnis von Handlungsphilosophie zu Handlungstheorien kann daher so gefaßt werden, daß Handlungsphilosophie die Grundbegrifflichkeit in kritischer Absicht bereitstellt, die den bereichsorientierten, mehr oder weniger deskriptiven Handlungstheorien abgehen muß. Dazu muß die ontologische Differenz von Handlung und Interpretation methodologisch ernst genommen werden. Die radikale Andersheit der hier zu begründenden Konzeption liegt vor allem in der Ansicht, daß Handlungen nicht als isolierbare Ereignis-Entitäten aufgefaßt werden können, die gegenüber der »Welt der Tatsachen des Bewußtseins« eine kausale, d.h. von der Welt des Bewußtseins abgetrennte Rolle übernehmen. In view of the scope and scale of the latest scandals, e.g. Enron's maximum breaking bankruptcy, the re-discovery of ethics in business has received an impressive boost. By now even car salesmen have written ethics, a Code of Conduct, e.g. in the USA or Poland. But there is no clear aim of the role ethics obtains in organizational settings as we may show in some small cases of practical approaches to deal with ethics in organizations. We discuss how ethics is (...) the prerequisite to conduct any business and what advantages may be realized if a clear set of ethics is followed. We will discuss three practical examples. In cases of ethics-based values-added management of Siemens (Germany), Boeing (U.S.) and SAP (Germany) we explain the mechanisms of ethics in management to strengthen organizational success. We emphasize the importance of clear ethics-related communication processes in organizations. We explain the use of communication theories inside organizational processes to clarify communication about such an abstract topic as ethics. Finally, we point out how a management of ethical ideas and cultural values should be designed in business enterprises. (shrink)
